Business Desk, New Delhi. The Bombay High Court has granted interim relief to the American fast-food giant Burger King. In a trademark infringement case, the court has said that a Pune-based restaurant cannot use the brand name till September 6. The court has banned the use of the brand name.

Last week, Burger King filed a petition in the High Court. In this petition, the company challenged the order of the Pune court. The Pune court dismissed the case against the Burger King restaurant located in Pune alleging trademark infringement. Burger King approached the High Court after the case was dismissed by the district court.

Bombay High Court imposed a stay

On Burger King’s petition, a division bench of Justice A.S. Chandurkar and Justice Rajesh Patil said on August 26, 2024 (Monday) that the court will hear the company’s application on September 6. The company has filed an application seeking interim injunction against the restaurant. The High Court said that the interim order issued by the Pune court in 2012 will be extended. Under this, the restaurant can no longer use the name “Burger King”.

The fast-food company also filed a lawsuit against the restaurant to stop using the name “Burger King”. The company said that the restaurant was also using the name “Burger King”, which was causing the company to lose business and damage its reputation.

The case was filed in 2011

Burger King Corporation had filed a case in Pune court in 2011. In this case, the company had said that a restaurant in Pune was using the name “Burger King”. Whereas Burger King Company had opened in America even before opening a shop in India.

After the interim order of Pune court, the company has now filed an application in the High Court. The company has appealed that the restaurants should not use the name “Burger King”. It has demanded an interim ban on the use of the name from the court.
